3. Product and Service Offerings
We provide oyster and seafood-related services by coordinating with independent chefs and third-party food establishments. Our services include:
- Ingredient Sourcing: Procuring premium oysters and seafood from reputable suppliers.
- Coordination of Culinary Services: Facilitating food preparation by independent chefs or third-party food establishments. These chefs and establishments are independent contractors, not employees or agents of The Oyster Cart.
- Delivery Services: Delivering ingredients and/or prepared food to your specified location.
Client Acknowledgment:
- Facilitator Role: The Oyster Cart acts solely as a facilitator and is not directly responsible for the preparation of food.
- Responsibility of Chefs and Establishments: Independent chefs and food establishments are fully responsible for the quality, handling, and safety of the food they prepare.
- Client Responsibility Post-Delivery: Once the food is delivered, the Client assumes full responsibility for its proper storage, handling, and consumption.
- Assumption of Risk: Consuming raw or undercooked seafood carries inherent risks, which the Client accepts by engaging our services.
4. Ordering and Payment
- Order Placement: Orders can be placed through our website or authorized channels. Payment must be made in full at the time of ordering unless stated otherwise.
- Order Confirmation: Your order is confirmed only after you receive a confirmation email from us.
- Rescheduling Policy: Orders can only be rescheduled at least 3 days prior to the delivery or event date, or whichever is earlier. No cancellations or refunds will be allowed once an order is placed.
- Pricing: Prices listed on our website are subject to change without prior notice.
5. Amendment, Refund, and Cancellation Policy
- Amendments (Rescheduling):
- Orders can be rescheduled at least 3 days prior to the delivery or event date, or whichever is earlier.
- Rescheduling requests made less than 3 days prior to the delivery or event date will not be accommodated.
- All rescheduling requests are subject to availability.
- No Cancellation or Refunds:
- Once an order is confirmed, it cannot be canceled, and no refunds will be issued.
- If you are unable to proceed with your order, you may request a reschedule under the terms above.
- How to Request Amendments: To request a reschedule, contact us at support@theoystercart.com or 87542207 with your order details. We will do our best to assist you.
6. Delivery Terms
- Delivery Times: While we strive to deliver within the agreed time, delays may occur due to traffic or unforeseen circumstances.
- Acceptance of Delivery: It is your responsibility to ensure someone is present to receive the delivery at the specified time.
7. Liability Clause and Waiver
By engaging with our services, you release The Oyster Cart Pte Ltd and its agents from liability for:
- Foodborne illnesses, adverse reactions, or contamination, unless directly caused by our gross negligence.
- Actions or omissions of independent chefs or third-party food establishments involved in the preparation of food.
- Issues arising from improper storage or handling of food after delivery.
You acknowledge and accept the inherent risks associated with consuming raw or undercooked seafood.
8. Use of the Website
By using this website, you agree to:
- Use it only for lawful purposes.
- Not misuse the website or attempt to compromise its security.
We reserve the right to terminate your access if we suspect misuse or violations of these Terms and Conditions.
